  • AUCTION TERMS & CONDITIONS:

    PROCEDURE: The property will be offered in 4 individual tracts, any combination of tracts, and as a total 47.6-acre unit. There will be open bidding on all tracts and combinations during the auction as determined by the Auctioneer. Bids on tracts, combinations, and the total property may compete.
    DOWN PAYMENT: 10% down payment on the day of auction with the balance in cash at closing. The down payment may be made in the form of cash, cashiers check, personal check, or corporate check. Your bidding is not conditional upon financing, so be sure you have arranged financing, if needed, and are capable of paying cash at closing.
    ACCEPTANCE OF BID PRICES: All successful bidders will be required to enter into purchase agreements at the auction site immediately following the close of the auction. All final bid prices are subject to Owners acceptance or rejection.
    EVIDENCE OF TITLE: Owner shall provide an owners title insurance policy in the amount of the purchase price.
    DEED: Seller shall provide Warranty Deed(s).
    CLOSING: Closing shall take place within 30 days of auction or within 15 days of proof of insurable titles.
    POSSESSION: Possession of the property will be given at closing on bare land tracts. Possession of Tract #2 with home and buildings will be 30 days after closing.
    REAL ESTATE TAXES: Will be prorated to closing date.
    ACREAGE: All tract acreages, dimensions, and proposed boundaries are approximate and have been estimated based on current legal descriptions and/or aerial photos.
    SURVEY: Owner shall provide a survey for any parcel where there is no existing legal description or where new boundaries are created by the tract divisions in this auction. Any need for a survey shall be determined solely by the Owner unless such surveys are required by state or local law. If a new survey is determined to be necessary, the Owner and Buyer shall pay for the cost of said survey on a 50:50 basis. The type of survey prepared shall be determined by the Owner, so long as it is sufficient for issuance of a title insurance policy.
    MINERAL RIGHTS: Sale shall include 100% of the mineral, oil, and gas rights owned by the Owner.
